Terms of Service

These Terms of Service govern your use of BannerArt, an AI tool for creating advertising banners for social media. By signing in or using BannerArt, you agree to these terms. If you do not agree, please do not use the service. Questions: o.malanii@evernode.tech.

1. Who can use BannerArt

• You must be at least 18 years old.
• BannerArt is used to create advertising for online casino and betting offers. You are responsible for making sure that creating and running such advertising is legal where you and your audience are, and that your ads follow the rules of the platforms where you publish them.

2. Your account

You sign in with your Google account. Keep access to it secure — you are responsible for activity under your account. We may suspend or block an account that breaks these terms or puts the service or other users at risk.

3. Tokens

• Generating or editing a banner uses tokens from your balance.
• Tokens have no cash value, cannot be transferred or exchanged for money, and are not refundable. If a generation fails, the tokens spent on it are returned automatically.
• Paid plans are not available yet. Free tokens (for example, at sign-up or as a one-time gift) are offered at our discretion and may change.

4. Acceptable use

You agree not to use BannerArt to create or upload content that:

• is illegal, misleading or deceptive — including promises of guaranteed or risk-free winnings;
• targets or depicts minors, or is sexually explicit, hateful, violent or harassing;
• infringes anyone's rights — for example, brands, logos, trademarks, sports teams or images you do not have permission to use;
• impersonates real people or uses someone's likeness without permission.

You also agree not to abuse the service — for example, by trying to get around token limits, safety checks or access controls.

5. Your content

• You keep any rights you have in the prompts and reference images you provide. Only upload images that you own or have permission to use. If you ask BannerArt to put a logo or brand from your image on a banner, you confirm you have the right to use it.
• You may use the banners generated for you, subject to these terms, the law and the terms of our image provider (OpenAI). We do not claim ownership of your banners.
• You give us permission to store and process your prompts, images and banners only as needed to run the service for you.

6. AI-generated results

Banners are created by AI and may contain mistakes, unexpected elements or text errors. Review every banner before you use it — you are responsible for the ads you publish. Similar prompts may produce similar results for different users.

7. Community examples

The Community section shows example banners for inspiration. "Reuse & Edit" copies an example into your My Work so you can adapt it; you are responsible for how you use the result.

8. Service availability

BannerArt is provided "as is" and "as available". We may change, pause or discontinue features at any time, and we do not guarantee that the service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, BannerArt is not liable for indirect, incidental or consequential damages, or for any loss arising from your use of generated banners or from ads you publish.

How we handle your data is described in our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. When we do, we will change the "Last updated" date above. If you keep using BannerArt after changes take effect, you accept the updated terms.
